Important Notice: Changes to Statewide Housing Security and Tenant Protection Act of 2019
We want to be sure that you are aware of newly enacted state legislation which significantly impacts landlord-tenant matters.
New York enacted the Housing Stability and Tenant Protection Act of 2019 providing for sweeping changes to rent and landlord/tenant laws with the stated purpose of protecting tenants while imposing new obligations and restrictions on landlords.
The Statewide Housing Security and Tenant Protection Act of 2019 was signed into law by Governor Andrew Cuomo on June 14, 2019 and parts of the law have already taken effect.
Some highlights of this Act include statewide provisions such as:
– Making it more difficult to evict a tenant, restricting grounds for eviction
– Restricting rent increases for manufactured homes;
– Prohibiting landlords from charging excessive security deposits;
– Restrictions and prohibitions as to certain fees;
– Criminalization of self-help remedies; and
– Imposing additional and stronger procedural restrictions and requirements and limiting the types of rent recoverable.
While some provisions have gone into effect on June 14, 2019, additional provisions will become effective on October 12, 2019.
