Navigating the Home Buying Process – The Important Initial Phone Call with your Attorney

As a real estate attorney, I have had the privilege of working with and guiding countless clients through the complex home buying process, especially first-time homebuyers.  It is an important and exciting journey, whether these clients are purchasing their first-time starter homes, returning clients purchasing their dream homes, or business clients purchasing commercial property for their new office. Each individual process is tailored for each individual client. A crucial part of the process, as an attorney working with each client, is the attorney’s initial phone call with each client.  I consider this initial conversation to be one of the most important aspects of the entire home buying process, and here is why:

  1. Explaining the home-buying process to each client:  Buying a new home can be a complex and exciting process.  As attorneys, we understand the excitement and anticipation come with a bit of anxiety.  It is our job to use this initial conversation to provide an overview of what is to come and what to expect.  We explain the legal steps involved and the process ahead, from reviewing contracts and inspection negotiations, drafting purchaser’s riders, reviewing title reports, and working hand in hand with the client’s lender until a closing is conducted.

2. Understanding the needs and goals of each individual client: Each home buyer is unique in their own way.  Each client has their own needs, expectations, preferences, and financial situations.  Some clients can purchase without any funding from a lender, while most need to work with a lender to purchase their new home.  The initial call is an opportunity to listen carefully to each of the specific needs, goals, and concerns of each client.  Does the client have specific legal questions?  Is the client using a lender to purchase their home?  Is the client going with a conventional loan or an FHA loan?  Is this client looking to use their residence as an investment property? These questions will provide us with crucial information, enabling us to tailor our services to each client’s needs.

  1. Building and Maintaining Trust: During the initial call, one of the most important goals is to build and establish trust. Purchasing a new home is a significant process in someone’s life and likely their largest investment. Buyers, no matter what the situation, need to feel confident that they have the right legal support on their side. As an attorney here at J&G, I take the time to introduce myself to each client, introduce our expertise in real estate law, and stress our commitment to each client’s success in the home buying process. 
  1. Setting expectations: Another important task we have is setting expectations for each client.  It is important to create realistic timelines and explain that the process doesn’t always go as planned, sometimes the process may encounter delays.  Being upfront and realistic with each client helps build trust and prepares the client for any bumps in the road.

The initial phone conference with each client is a very important moment during the home-buying process.  The call gives the client a chance to establish trust, giving a sense of comfort while allowing the attorney to understand the needs of the client and provide guidance that allows for a successful transaction.
